These Terms of Service ("Terms") govern your access to and use of the SoloKeys website (solokeys.com), your purchase of SoloKeys products, and your use of any related services offered by SoloKeys, located at 2035 Sunset Lake Road, Suite B-2, Newark, DE 19702, United States.

By accessing our site or placing an order, you agree to these Terms. If you do not agree, please do not use our site or services.

Note for EU / EEA customers: Where EU consumer protection law provides you with rights that differ from or exceed those described here — including the Consumer Rights Directive 2011/83/EU, Sale of Goods Directive 2019/771, and GDPR — those statutory rights always apply and cannot be waived by these Terms.

The company behind Solo 2 and the open source security key movement.

SoloKeys is a hardware security company focused on digital sovereignty. We design, manufacture, and sell open source FIDO2 / WebAuthn security keys — hardware and firmware you can fully audit, build, and trust.

SoloKeys products are built on fully open source hardware designs and firmware. Our source code, schematics, and build instructions are publicly available on GitHub so that anyone can audit, verify, and contribute.

Open Source Licenses

Hardware and firmware are published under open source licenses documented at github.com/solokeys:

  • Firmware (Solo 2): Apache License 2.0 and MIT License
  • Hardware schematics: CERN Open Hardware Licence v2
  • Software libraries and tools: Apache License 2.0 or MIT, as specified per repository

Your rights under open source: You are free to audit the source code, build your own firmware, and contribute improvements — subject to the applicable open source license. These Terms govern your commercial relationship with SoloKeys. They do not restrict rights granted by open source licenses.

Solo 2 Hacker Edition

The Solo 2 Hacker is a developer-focused device for custom firmware development. It does not include attestation certificates. By purchasing a Solo 2 Hacker, you acknowledge that you are using the device for development purposes, and that SoloKeys provides no warranty against user-applied firmware modifications.

3. Services & Products

What we sell and what this site is for.

Solokeys.com is an e-commerce website where we market and sell hardware security keys and related accessories. Visitors and customers are collectively referred to as "users."

  • Solo 2+ — USB-A and USB-C, FIDO2 / WebAuthn, includes NFC
  • Solo 2 Hacker — Developer device, custom firmware capable, no attestation

Service Changes

SoloKeys reserves the right to update, modify, add, or discontinue products and services at any time. We will make reasonable efforts to communicate material changes. Your continued use of our site after changes are posted constitutes acceptance of the updated Terms.

Unlike competing products: Firmware updates for Solo 2 are included and free — your key will never become artificially obsolete. We don't lock features behind a subscription or charge for security patches.

4. Purchases & Pricing

What you need to know before you buy.

All prices are displayed in US Dollars (USD) unless otherwise stated. Prices in effect at the time of your order confirmation are final for that transaction.

Taxes & Duties

Sales tax is applied where required by applicable law. For international orders, customs duties and import taxes may be assessed by your local customs authority. These charges are the buyer's responsibility and are not collected by SoloKeys at checkout.

EU Customers: Goods shipped to EU addresses may be subject to VAT upon import. SoloKeys complies with applicable reporting obligations. Questions? Contact [email protected].

Order Acceptance

Placing an order does not constitute a binding contract until SoloKeys sends an order confirmation email. We reserve the right to cancel or refuse any order for reasons including pricing errors, product unavailability, or suspected fraudulent activity. If an order is cancelled after payment, a full refund will be issued promptly.

Returns & Refunds

Our Returns & Refunds Policy is incorporated into these Terms by reference, including our 6-month hardware warranty.

5. Accounts & Eligibility

Who can use our site and create an account.

You must be at least 18 years old to purchase from SoloKeys, or have the consent of a parent or guardian. By using this site, you represent that you meet this requirement.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Please notify us immediately at [email protected] if you suspect unauthorized access.

SoloKeys reserves the right to terminate or suspend accounts that violate these Terms, engage in fraudulent activity, or otherwise misuse our services.

6. User Content & Contributions

What happens when you submit feedback, reviews, or ideas.

When you voluntarily submit feedback or suggestions to SoloKeys:

  • You grant SoloKeys a worldwide, royalty-free, non-exclusive license to use, reproduce, and display that content solely in connection with operating and promoting our services.
  • You confirm your submission does not contain confidential information belonging to a third party.
  • SoloKeys may act on or disregard contributions at its discretion, without obligation to compensate contributors.

Open source contributions are different. Code, documentation, and hardware design contributions submitted to our GitHub repositories are governed by the open source license of the relevant project and any applicable Contributor License Agreement — not by these general Terms.

Prohibited Content

You agree not to post or transmit content that:

  • Is unlawful, defamatory, harassing, or fraudulent;
  • Infringes the intellectual property rights of any third party;
  • Contains malware, viruses, or malicious code;
  • Violates any applicable export control law.

7. Intellectual Property

Open source where possible. Proprietary where necessary to protect the brand.

Trademarks

"SoloKeys," "Solo 2," "Solo 2+," "Solo 2 Hacker," "Trussed," and associated logos are trademarks of SoloKeys. You may not use these marks without prior written permission, except in nominative fair use contexts such as referring to SoloKeys products in a review or article.

Website Content

The textual content, images, and design of solokeys.com — excluding open source–licensed materials — are owned by SoloKeys and protected by copyright. You may not reproduce or distribute our site content without permission.

Open Source Software & Hardware

Our hardware schematics, PCB designs, and firmware are published under open source licenses as detailed in Section 2. If there is any conflict between these Terms and an applicable open source license, the open source license governs with respect to the licensed materials.

Commercial Restrictions

You may not scrape, replicate, or commercially exploit our website, product listings, or brand assets without express written consent from SoloKeys. Resale of SoloKeys products purchased in good faith is permitted, but you may not misrepresent the source, condition, or authenticity of products.

8. Export & Import Compliance

Legal obligations when moving cryptographic hardware across borders.

SoloKeys products include cryptographic technology subject to US Export Administration Regulations (EAR) and equivalent regulations in other countries. By purchasing, you represent and warrant that you:

  • Are not located in, or acting on behalf of, a country subject to US government embargo;
  • Are not listed on any US Government denied-party list, including the BIS Entity List or OFAC SDN list;
  • Will not use, transfer, or re-export SoloKeys products in violation of US export laws or applicable local law;
  • Will not use SoloKeys products for military, nuclear, chemical, or biological weapons end uses.

EU Dual-Use Regulation: Customers within the EU should be aware that cryptographic hardware may also be subject to EU Dual-Use Regulation (EU) 2021/821. SoloKeys complies with applicable EU export control obligations.

9. Privacy & Data

Your credentials stay on your hardware. Your personal data stays protected.

SoloKeys is committed to data minimization. Our security keys store credentials locally on the device — no cloud sync, no SoloKeys servers, no third-party backup. Your authentication data belongs to you.

Personal data we collect through our website (name, email, shipping address, order history) is used solely to process transactions and provide customer support. Our full Privacy Policy is incorporated into these Terms by reference.

EU / GDPR Rights: If you are in the EU or EEA, you have rights under the GDPR including the right to access, correct, delete, or port your personal data, and to object to certain processing. To exercise these rights, contact [email protected]. You also have the right to lodge a complaint with your national Data Protection Authority.

10. Warranty Disclaimer

What we promise — and what we don't.

SoloKeys provides a 6-month limited hardware warranty covering defects in materials and workmanship under normal use. Full warranty terms are in our Returns & Refunds Policy.

Disclaimer of Additional Warranties: Except for the express 6-month hardware warranty, SoloKeys services, software, and website are provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. SoloKeys does not warrant that the site will be uninterrupted, error-free, or free from security vulnerabilities. This disclaimer does not affect your statutory rights.

EU Statutory Conformity Rights: Under EU Directive 2019/771, consumers in EU member states are entitled to a minimum 2-year legal guarantee of conformity for physical goods. This statutory right is in addition to, and not limited by, our 6-month commercial warranty.

11. Limitation of Liability

The extent of our financial responsibility to you.

To the maximum extent permitted by applicable law, SoloKeys and its officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of (or inability to use) our products, services, or website. Our total aggregate liability for direct damages shall not exceed the amount you paid to SoloKeys for the product or service giving rise to the claim in the 12 months preceding the event.

EU / Consumer Protection Note: Nothing in these Terms limits liability that cannot be excluded under applicable consumer protection law, including liability for death or personal injury caused by negligence, or for fraud. EU consumers retain all statutory rights regardless of these limitations.

12. EU Consumer Rights

A consolidated summary for customers in EU and EEA member states.

Right of Withdrawal (14-Day Cooling-Off Period): Under the EU Consumer Rights Directive (2011/83/EU), EU consumers have the right to withdraw from a distance purchase within 14 calendar days of receiving their order, without giving a reason. To exercise this right, notify us at [email protected] before the period expires. We will refund the full product price plus standard shipping within 14 days of receiving the returned goods. Return shipping costs are the buyer's responsibility unless the item is defective.

2-Year Legal Guarantee

EU consumers are entitled to a 2-year legal guarantee of conformity under Directive 2019/771. This supplements our commercial 6-month warranty. Contact [email protected] to make a conformity claim.

Online Dispute Resolution

The European Commission provides an Online Dispute Resolution platform: ec.europa.eu/consumers/odr. We are willing to participate in alternative dispute resolution proceedings where required by applicable law.

Applicable Law for EU Consumers

EU consumers may always invoke the mandatory consumer protection provisions of the law of their country of residence. The choice of law clause in Section 16 does not deprive you of protection under provisions that cannot be derogated from by agreement.

13. Indemnification

Your responsibility for your own actions.

You agree to defend, indemnify, and hold harmless SoloKeys and its officers, directors, employees, agents, and licensors from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:

  • Content you submit to our site;
  • Your violation of these Terms;
  • Your violation of any applicable law or third-party right;
  • Your use of our products or services in a manner inconsistent with their intended purpose.

14. Third-Party Links

We link to external resources. We don't control them.

Our website may contain links to third-party websites including GitHub, FIDO Alliance documentation, and partner sites. These links are provided for convenience. SoloKeys does not endorse, control, or assume responsibility for the content, privacy practices, or availability of any third-party site.

Your use of third-party sites is at your own risk and subject to their own terms and privacy policies.

15. Changes to These Terms

We'll tell you when things change.

SoloKeys may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you by email or via a notice on our website.

Your continued use of the site or our services after revised Terms are posted constitutes your acceptance of the changes. If you do not agree, please stop using our services.

EU Consumers: We will provide at least 15 days' advance notice of material changes via email where required by applicable law.

16. Governing Law & Disputes

How and where disputes get resolved.

US Customers

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any legal action shall be brought exclusively in the federal or state courts located in New Castle County, Delaware, and both parties consent to personal jurisdiction and venue in those courts.

Statute of Limitations

Any claim arising out of or related to these Terms must be filed within one (1) year after the cause of action arose, to the extent permitted by applicable law.

Waiver & Severability

Failure by SoloKeys to enforce any provision of these Terms does not constitute a waiver of that right. If any provision is found invalid by a court of competent jurisdiction, the remaining provisions remain in full force and effect.

EU Consumers: EU consumers may always bring claims in the courts of their country of residence, and their mandatory local consumer protection laws apply regardless of the Delaware choice-of-law clause.

17. Intellectual Property Infringement Claims

If you believe your IP has been infringed, here's how to tell us.

To submit an infringement notice, please provide:

  1. Your physical or electronic signature (or that of an authorized representative);
  2. Identification of the copyrighted work or IP you believe has been infringed;
  3. The URL or specific location on our site where the infringing content appears;
  4. Your contact information (name, address, telephone, and email);
  5. A statement of good-faith belief that the use is not authorized by the rights holder, its agent, or the law;
  6. A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the rights holder.

18. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and Returns & Refunds Policy, constitute the entire agreement between you and SoloKeys with respect to your use of our services and supersede all prior agreements on that subject.

No Third-Party Beneficiaries

Unless otherwise expressly stated, these Terms do not create any third-party beneficiary rights.

Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. SoloKeys may assign its rights and obligations without restriction.

Notices

Notices from SoloKeys may be provided via email or posted on the website. Notices to SoloKeys should be sent to [email protected] or to our mailing address.

Accessibility
